Terms of Use

Welcome to The Oyster Journal. These Terms of Use (“Terms”) form a legally binding agreement between you (“you” or “user”) and The Oyster Journal (“we,” “our,” or “us”) regarding your use of our mobile application and related services (the “App”).

By downloading or using the App, you agree to these Terms.

1. License to Use the App

  • The Oyster Journal App is licensed, not sold, to you.
  • We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, in accordance with these Terms.
  • You may not distribute, sublicense, rent, lease, or make the App available over a network where it could be used by multiple devices at the same time.
  • You may not copy, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App except where such restrictions are prohibited by law.

We retain all ownership rights not expressly granted to you under these Terms.

2. Subscriptions and Payments

  • The Oyster Journal offers auto-renewing subscription plans, including Premium Monthly and Premium Yearly.
  • Payment will be charged to your Apple ID account at confirmation of purchase.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours before the end of the current period at the same price and term you selected.
  • You can manage or cancel your subscription at any time in your Apple ID Account Settings.

3. Consent to Use of Technical Data

You agree that we may collect and use technical data and related information about your device, system, and App usage. This data may be used to provide updates, support, and improve our products and services, provided it does not personally identify you.

4. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you agree to the collection and use of your information as described in that policy.

5. User Content

You may create and submit content such as oyster journal entries and reviews. You retain ownership of your content, but you grant us a non-exclusive, worldwide, royalty-free license to display, distribute, and use your content within the App.

6. External Services

The App may contain links to or integrate with third-party websites or services (“External Services”). We do not control or guarantee the accuracy, content, or availability of External Services and are not responsible for any losses or damages resulting from your use of them. Your use of External Services is at your own risk and subject to their own terms.

7. Prohibited Conduct

You agree not to:

  • Use the App for unlawful purposes
  • Attempt to hack, reverse engineer, or disrupt the App
  • Post or share offensive, misleading, or infringing content

8. Termination

We may suspend or terminate your account or access to the App at any time, without notice, if you violate these Terms or misuse the App. Upon termination, you must stop using the App and delete all copies from your devices.

9. Intellectual Property

All content, trademarks, and data within the App (including the oyster database, graphics, and branding) are owned by The Oyster Journal and protected by copyright, trademark, and other laws.

10. Disclaimer of Warranties

The App is provided “as is” and “as available” without warranties of any kind. We make no guarantees that the App will always be available, accurate, or error-free.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages resulting from your use of the App. Our total liability to you for any claims shall not exceed fifty U.S. dollars ($50.00).

12. Export Control

You may not use or export the App except as authorized by U.S. law. You represent that you are not located in a country under U.S. embargo and are not on any U.S. government restricted party lists.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law rules.

14. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted here and will take effect upon posting. Continued use of the App after changes are posted means you accept the revised Terms.
